Oakley v Osiris Trustees Ltd [2008] UKPC 2

The court found on the evidence that the Staff of Government Division of the High Court of Justice of the Isle of Man had erred in finding that trustees who had produced a resolution providing for a change of the proper law of two trusts from the law of Jersey to the law of the Isle of Man did not have the requisite intention. The trustees' failure to consider what formalities were necessary was lamentable, but doubts about the effectiveness of the document could not alter their intention for it to have legal effect.
