I have been involved in several cases before the social security commissioners dealing with the right to reside test which claimants must satisfy in order to be eligible for income support. I am regularly instructed on behalf of the Secretary of State for Work and Pensions in these test cases on the boundaries of the right to reside test which involve arguments as to the scope of EU law on workers' rights and other treaty rights. Judgment is awaited in this particular case.
