Makar v Russell Jones & Walker and others [2012] EWHC 3681 (Comm)

In this case, the Claimant sued a number of individuals and organisations in connection with allegations of financial and professional misconduct. She also sued the Director of the Serious Fraud Office, alleging that he had failed to exercise his powers of investigation against certain of the relevant organisations pursuant to s.2 of the Criminal Justice Act 1987. Following a 2 day hearing in the Commercial Court, Andrew Smith J struck out the claims. Charles Banner acted for the Serious Fraud Office, one of the successful defendants, instructed by the Treasury Solicitor.
