London Borough of Southwark & City of London Corporation v Transport for London [2015] EWHC 383 (Ch)

This was an application for permission to appeal under s.69 Arbitration Act 1996 against arbitrator’s determination of the extent of highways and other property transferred from Southwark LBC and the City of London Corporation to Transport for London under the GLA Roads and Side Roads (Transfer of Property Etc.) Order 2000. Granting permission to appeal, Morgan J. commented on the evidence that the Court might expect to be provided with an application for permission to appeal an arbitrator’s award under s.69 of the 1996 Act. The substantive appeal is awaiting hearing.
