London Borough of Lambeth v O'Kane / Helena Housing Association v Pinder

The Court of Appeal considered the circumstances from which the grant of a new tenancy may be inferred from the conduct of the parties to a former tenancy in relation to social housing. The court accepted the principle that no new tenancy should be inferred unless the factual circumstances forced this conclusion.  Demands for rent, the service of rent books and correspondence addressed to the tenant did not.
