Legal challenge to South Oxfordshire Local Plan rejected for second time

The High Court has refused to give Bioabundance CIC permission to bring its claim for judicial review of the South Oxfordshire Local Plan 2035. Lang J concluded that the claim was unarguable following an oral hearing on 29th April.  Dove J had previously reached the same view on the papers. Robert Walton QC advised and acted for South Oxfordshire District Council throughout the plan preparation stages, at Examination in Public and in respect of its decision to adopt the Plan.

Jenny Wigley QC and Alex Shattock represented the claimant Bioabundance CIC in the renewal hearing, instructed by Tom Short at Leigh Day.

Tim Buley QC (with Alex Shattock) previously represented the Claimant but was unable to attend the hearing because of paternity leave.
