Lee and Wells v United Kingdom (ECHR)

The case concerned prisoners detained under sentences of Imprisoment for Public Protection (IPPs) where there had been prolonged periods when they did not have access to rehabilitative course. The European Court of Human Rights found that there was a breach of Article 5(1) because the detention had been disproportionate in the light of the failure to give sufficient resources to provide the relevant courses. Nathalie Lieven QC represented the UK Government.
