Judicial reviews brought against HS2 by local authorities and HS2AA

Judicial reviews against the Government's decision to proceed with its strategy for HS2 have been lodged with the Administrative Court by the HS2 Action Alliance representing many community interest groups in the areas affected by the proposed high speed rail link and by a consortium of local authorities in those areas. The grounds of challenge include failure to comply with the EU requirements for SEA in producing the strategy and in respect of the Habitats Directive/Regulations and also with regard to defects in consultation and over DfT's claim that the Hybrid Bill process will meet the requirements of EIA. It is understood that there are other judicial review claims in preparation. David Elvin QC represents the HS2 Action Alliance. Tim Mould QC and James Maurici represent the DfT.
