The High Court in Northern Ireland heard a challenge by RES to a refusal by the Planning Appeals Commission to grant permission for a wind farm development in Northern Ireland. The main issue was the interpretation of planning policy relating to the protection of priority habitat, in particular when and how mitigation and compensatory measures could be taken into account when applying the policy.
