HOTT v ABP [2012] EWHC 1336 (Ch) (18/5/12)

The Chancery Division gives important guidance on the assessment of interim rent pursuant to section 24D of the Landlord and Tenant Act 1954. In particular the court spells out the interrelationship between sections 24D and 34 of the Act and how, for valuation purposes, one treats fixtures which the tenant has a right to remove. The court assessed interim rent at over £14.8 million. David Holland QC appeared for the landlord.
