Horada v Secretary of State for Communities and Local Government [2016] P.T.S.R. 1271

Appeal against the dismissal by Dove J. of a challenge under s.23 of the Acquisition of Land Act 1981 by members of the Shepherd’s Bush Market Traders’ Association against the Secretary of State’s decision to confirm the CPO made by the London Borough of Hammersmith and Fulham to facilitate the multi-million point regeneration of Shepherd’s Bush Market. The Court of Appeal (Lord Thomas CJ; Longmore & Lewison LJJ) made important observations on the need for public authorities to ensure that the reasons they give for their decisions are understandable not merely by experts and lawyers but also by lay citizens. Charles Banner appeared for the Secretary of State for Communities and Local Government. Rupert Warren QC appeared for Orion (Shepherd’s Bush) Ltd, the interested party developer.
