Hicks v 89 Holland Park (Management) Ltd [2014] EWHC 2962 (Chancery Division)

This case involved an application for an injunction in long running litigation concerning restrictive covenants affecting a potential development site. The issue of principle which it addressed was whether an interim injunction could be granted to restrain the making of an application for planning permission for a development in circumstances where such a step could be determined at trial to be a breach of covenant and would cause loss to the applicants, but where the respondent might have less chance of securing planning permission if the application was delayed.
