Henry v Henry [2010] 1 All E.R. 988

Successfully represented the Appellant in the Privy Council (St Lucia). The Court of Appeal of the Eastern Caribbean Supreme Court had adopted an erroneous approach to the issue of detriment in considering a proprietary estoppel claim. It had failed to weigh any disadvantages suffered by the claimant by reason of his reliance on the promise against any countervailing advantages which he had enjoyed by reason of that reliance.
