GOOD HARVEST V CENTAUR [2010] EWHC 330 (Ch): the High Court finally decided the question that had been much debated since the enactment of the Landlord and Tenant (Covenants) Act 1995 as to whether a guarantor of an original tenant can be made to enter into an Authorised Guarantee Agreement along with the tenant itself. The Court decided that any guarantee of an assignees covenants entered into by the guarantor of an original tenant was rendered void by section 25 of the Act. David Holland acted for the successful guarantor.
