Preliminary issue as to whether repairing liabilities of a tenant and sub tenant under leases in identical terms were the same. It was held that they were not, because the liability of the sub tenant had to take account of the condition of the premises at the start of the lease and the length of the sub tenancy. Thomas Jefferies acted for the successful claimant.
