Falmouth House Freehold Ltd v Rahimzadeh [2008] NPC 17

A participation agreement had been entered into by the participating leaseholders of a collective enfranchisement of a block of flats near Hyde Park. The agreement provided that the price, which was ultimately agreed at £3.1m, would be allocated between the participating leaseholders by a named surveyor acting as an expert. On an appeal, Morgan J held that the surveyor had made a binding determination that could not be re-opened on the ground of mistake. Tom Weekes appeared with Edwin Johnson QC in the High Court.
