Fairfield N12 Freehold Ltd v Hertsmere Property Co Ltd, FTT, LON/00/AC/OCE/2019/0059

Dispute as to price payable in a collective enfranchisement claim for six blocks in North London premises. The dispute concerned the value of the potential to build an extra flat on each block. There were issues as to the assessment of the site value, the profit margin to allow, and the appropriate discounts for planning and legal risks. The landlord sought a premium of £141,000 per block. The Tribunal assessed the value as £70,000 per block, preferring to accept the evidence and arguments of the tenants (for whom Tom acted) on most issues.
