European Court dismisses Commission's appeal in Case C-504/09 Commission v Poland

The Court of Justice of the European Union today dismissed an appeal by the Commission against the annulling by the Court of First Instance of the European Communities, now the General Court, of its decision concerning the national allocation plan for emission allowances notified by Poland for the period 2008 - 2012 under Directive 2003/87/EC establishing a scheme for greenhouse gas emission allowance trading in the Community. The appeal was supported by Denmark and by the United Kingdom. James Maurici appeared for the United Kingdom as interveners in the case before the General Court and made written submissions on behalf of the United Kingdom on the appeal.
