A master had not erred in striking out a community association’s defence of legitimate expectation in relation to a claim for specific performance of a contractual obligation to transfer land back to a local authority. The obligation to transfer the land in the event of non-completion by the contractual deadline was a contract for the disposition of an interest in land within the ambit of the Law of Property (Miscellaneous Provisions) Act 1989 s.2. Acted for the Respondent council.
