Dennis v. MOD

[2003] EWHC 793 (QB). Acted for the MOD defending a noise nuisance & Human Rights Act claims against RAF Wittering. See The Times and Guardian articles 11.3.03. RAF Wittering is “the Home of the Harrier”. Judgment given by Buckley J. on 16.4.03 in which he awarded £950,000 damages to the claimants (less than the £10m plus claimed) on a basis which, pursuant to the Convention, balanced the rights of the claimants with the public interest in the defence of the realm.
