Cusack v Harrow LBC [2013] 1 WLR 2022

The Supreme Court (allowing an appeal from the Court of Appeal) held that Harrow LBC could exercise powers under section 80 of the Highways Act 1980 to prevent a frontager obtaining vehicular access to his property from the highway, even though no compensation was payable under that provision.  Lord Neuberger’s speech contains important guidance about the role of canons of construction in the interpretation of statutes and contracts.
