Co-Op Bank plc v Hayes Freehold Ltd [2018] EWHC 1058

A deed of surrender of a headlease had been purportedly entered into but without the consent of the claimant bank. The deed of surrender was therefore void and ineffective. The court was willing to exercise its discretion to order declaratory relief to this effect on an application for judgment on admissions, in order to vindicate the claimant’s rights and to do justice between the parties.
