This case concerned a claim for a declaration and mandatory injunction, arising from the alleged infringement of a right to light for premises overlooking a site on which development was proposed following the completion of the Crossrail project. The Chancellor held that the claim was premature and served no useful purpose since the proposed development had not received planning permission and could not take place for several years.
