Bracknell Forest DC v Reed and Keeling (Reading Crown Court)

This was a prosecution for breach of a TPO, heard in the Crown Court. The defendants argued that the TPO was invalid since the text of the order suggested that the order was a group order, but failed to enumerate the trees, as required by the Regulations.  Also the order suggested that the protected trees were identified by a dashed line whereas the plan only had a solid line.  The Judge ruled that the order was valid and both defendants were convicted. Richard Langham appeared for the prosecution.
