ABP v Hampshire County Council

This case concerned the first High Court challenge to a minerals and waste core strategy. Associated British Ports challenged the inspector’s approach to the consideration of their objections to the failure of the core strategy to safeguard Dibden Bay as a minerals wharf. The court had to consider the concept of “soundness” introduced by the Planning and Compulsory Purchase Act 2004, and the approach to be taken to conformity with regional guidance.
