Two arbitrations under agreements to sub-let half of a large store on two different sites to another retailer. The prospective tenant sought to rescind on the ground that the planning permissions which had been granted were granted subject to onerous conditions as defined in the relevant agreements. Following the arbitrator’s awards an application has been made to the High Court to set aside the decision and/or for permission to appeal on an issue of law as to the construction of the agreement.
