No.1 West India Quay (Residential) Ltd v East Tower Apartments Ltd [2016] EWHC 2438 (Ch)

Acting for the appellant in an appeal relating to the refusal of consent to assign underleases. It was held that the landlord was entitled to impose a condition that the proposed assignees provide bank references as assurance of their ability to perform covenants involving expenditure. It was also reasonable, as a prerequisite for giving consent, for the landlord to instruct a surveyor to check whether repair covenants had been complied with.
