Tom acted for the freehold owner of this prime residential property in seeking consent under the Grosvenor Estate Management Scheme for consent to the demolition of the existing house and construction of a new larger house with an additional basement. Grosvenor refused consent on numerous grounds, including objections to the scale and appearance of the new building and to the new basement. An application was made to the Upper Tribunal under section 84 of the Law of Property Act 1984 to modify the covenants to allow the proposed development. After a five year battle Grosvenor eventually granted consent.
