Public Works Projects

Landmark has a wealth of experience and expertise in assisting our public sector and private clients in implementing major public infrastructure projects in the UK and elsewhere, and managing litigation risk in relation to those projects. We provide advice and representation in respect of issues arising throughout the lifecycle of infrastructure projects, from scheme design and planning, property disputes and compulsory purchase, financing including public procurement and subsidy control, and post implementation disputes.

Overview

Our work covers obtaining development and other consents, providing strategic advice on the promotion of major schemes, and addressing compliance with environmental law, and procurement, regulatory and contractual issues, construction disputes and. We have experience of acting for developers, investment funds and banks, central government, local and regional government, other regulatory bodies, third parties, and NGOs.

Barristers at Landmark have experience across a broad range of sectors. Some examples are:

Transport infrastructure: High Speed 2 and Crossrail; airport expansion at London Heathrow, London Gatwick, Stansted and London City, and Belfast City Airports; road network upgrades such as the “smart motorway” roll out, and the Silvertown Tunnel (Thames crossing); and deep sea container ports at Bristol and Bathside Bay.

Energy and utilities: energy generation schemes at Hinckley Point (nuclear); Hornsea, Navitus Bay and Burbo Bank (offshore wind);  RPP and temporary power programmes (Pakistan and the Caribbean), energy from waste schemes at Rookery South, Brig y Cwm and Merseyside; the Keuper Gas Storage Project; Swansea Tidal Lagoon; major interconnectors such as Tyrone-Cavan (Northern Ireland) and the North Wales Connection; and the Thames Tideway Tunnel (London’s new sewer).

Urban development: tall buildings such as The Shard and the “Walkie Talkie” in London; major retail schemes such as Westfield’s £1bn new centre in Croydon, south London; major mixed-use schemes such as Kai Tak Mansion (Hong Kong) and Ram Brewery (London), and the London Olympic Stadium.

As a result, we have experience of dealing with numerous technical areas: environmental assessment; tunnelling and other heavy engineering; noise; marine licensing; traffic; construction logistics; air quality – the list goes on.

We also regularly deal with litigation arising from these projects: for example, the High Speed 2 case in the UK Supreme Court; Hong Kong litigation on the Lung Kwu Sheung Tan Asphalt Plant; the High Court challenge to the award of the Olympic Stadium lease, and the Stonehenge A303 tunnel.
