Permission to appeal granted in key case relating to s.73 variations

The Court of Appeal has given permission to appeal in the case of Finney v Welsh Ministers [2018] EWHC 3073.  This case concerns whether s.73 of the TCPA can be used to effect variations to the operative part of a planning permission.  This is the first time that the Court of Appeal has considered this issue, and the outcome is likely to have a significant impact on the use of this important power.
