Unlawful Deportation Orders

Stephen Knafler QC and Galina Ward (instructed by Nichola Burgess of JCWI) appeared for Mr Hersi Guled in his successful appeal to the Court of Appeal. The Court of Appeal held that  the Secretary of State had withdrawn Mr Guled's deportation order on the basis that it had been invalidly (i.e. unlawfully) obtained and that, consequently, the deportation order had to be treated as being a nullity and as not having invalidated Mr Guled's LTR.
