Parliamentary Committee Report on Unlocking Community Energy Published Jenny Wigley KC

The Energy Security and Net Zero Committee has today published its report on recommendations to upscale and incentivise community energy. These include legislating to make enhanced community benefits material considerations in planning applications for commercial renewable projects.

Jenny Wigley KC appeared before the Committee in November, providing her expertise on planning law and the current impediments to the legal ability to give positive weight in the planning balance to community benefits and ownership models. There was discussion on the implications of the Supreme Court judgment in R (oao Wright) v Resilient Energy Severndale Ltd [2019] UKSC 53, a landmark case concerning judicial review of a planning permission for a community wind-turbine development (a case in which Jenny had appeared for the developer).
