This week, a planning inquiry closed concerning land at Quin Hay Farm, Petersfield, in the South Downs National Park. The inquiry concerned two conjoined appeals: an enforcement appeal against an enforcement notice alleging breach of a planning condition restricting the use of the site to classic car servicing and online sales, and an appeal against the refusal of a Lawful Development Certificate for a claimed agricultural machinery dealership use.
The core issue was whether the current use of the site by ‘Just Tankers' for tanker storage, sales and repair was lawful, either by virtue of the continuation of a historic use or by immunity from enforcement.
