Graeme advised and represented Northcote Western at appeal against refusal of permission for demolition of a church hall and construction of a 4-storey development comprising a childrens’ nursery and residential dwellings on the first and second floor.

Instructed late in the process, Graeme advised on production of evidence and called witnesses dealing with planning, need for nursery places, design, nursery standards, highways (including access), noise and overlooking. A particularly contentious issue was the local planning authority’s unjustifiable persistence in demanding a s.106 obligation to secure 4 bursary places in perpetuity and which was found not to meet the requirements of the TCPA and the CIL Regulations.

Permission granted and a full award of costs made against the Council – May 2025.
