Wimbledon Back in Court: Judicial Review Granted

Allies and Morrison and All EC provided by RH

On 21 July, a Judicial Review of the grant of planning permission for the extension of the All England Club including an 8,000 show court for the Wimbledon Championship, 38 new lawn tennis courts and improvements to the neighbouring Wimbledon Park and lake was dismissed by Mr Justice Saini. The judgment considers when and how deliverability may be a material consideration in planning decision making and also the correct interpretation of paragraphs 202 and 103 of the NPPF.

However, on 19 November 2025, The Rt. Hon. Lord Justice Holgate granted permission to appeal to the Court of Appeal, citing the following reasons:

The grounds of appeal are arguable with a real prospect of success. The case law on scheme benefits, deliverability, relevance, material considerations and irrationality merits review by the Court of Appeal.

The hearing is likely to take place in the new year in the Court of Appeal.

Sasha White KC and Luke Wilcox appeared for the Claimant, instructed by Russell Cooke Solicitors.

Russell Harris KC and Andrew Parkinson appeared for the All England Club, instructed by CMS Cameron McKenna Nabarro Olswang LLP.
