A claim concerning ‘loss of chance’ damages in which Mr Justice Fancourt concluded that there was a 60% chance that the claimant would have obtained planning permission for a 640-unit scheme development if the defendant had properly performed its obligations in relation to the integration of the claimant’s designs with its own development proposals.
