High Court hears constitutional case on…

The High Court (Lieven J) has heard part of a challenge to a decision of the Prime Minister to advise the King to revoke the award of a CBE. The claim is brought on administrative law and human rights grounds.

The Prime Minister sought a preliminary hearing to determine whether honours decisions are justiciable such that they cannot ever be challenged by judicial review.

This is the first ever case in this jurisdiction to consider the question. It has been widely reported in the press.
