High Court dismisses 1 3 billion national lottery procurement challenge James Neill and Barney Mc Cay

Following a trial lasting more than two months, the High Court has comprehensively dismissed claims brought against the Gambling Commission by Northern & Shell plc and The New Lottery Company Limited.

The claims arise out of what the claimants described as “the most financially significant procurement process in UK history” (i.e. the competition for the 4th UK National Lottery Licence and modifications made to the Licence following its award to Allwyn in 2022), with damages sought of up to £1.3 billion.

This is the third successful outcome for the Commission, following earlier proceedings brought by Camelot and IGT.

Barney McCay, instructed by Hogan Lovells, was part of the counsel team that successfully acted for the Gambling Commission. James Neill also acted for the Commission earlier in the proceedings.
