On 17 October 2025, Myriam Stacey KC and Joel Semakula successfully obtained continuations of the final injunctions granted by Mr Justice Dexter Dias on 3 December 2024 in three separate claims on behalf of Shell in the High Court. The judgment of Mr Justice Eyre considers:
- the scope of the difference in approach to be taken in renewals versus reviews;
- the applicability and legal relevance of the unincorporated Aarhus Convention for the second time in these direct action environmental cases and following the decision of the Court of Appeal in R v Hallam [2025] EWCA Crim 199 at [47] – [50]; and
- Mr Justice Nicklin’s observations in MBR Acres Limited v. Curtin and Persons Unknown [2025] EWHC 331 (KB), in which he took a different approach to the description of ‘Persons Unknown’ defendants and contempt applications in this context.
