Divisional Court finds proscription of Palestine Action unlawful

On 13 February 2026, the Divisional Court held that the Home Secretary’s decision to proscribe Palestine Action was unlawful.

The Court found that the Home Secretary failed to comply with her own policy when making the decision to proscribe Palestine Action and that proscription breached the rights of freedom of expression and assembly, and association, as protected by Articles 10 and 11 of the European Convention on Human Rights.

The parties have until 20 February 2026 to make submissions on relief and the proscription order remains in force pending further order.
