Court Grants Broxbourne Borough Council Planning Injunction Against Persons Unknown

On 6 October 2025, the Court granted Broxbourne Borough Council an injunction - pursuant to s.187B of the Town and Country Planning Act 1990 - against persons unknown/newcomers in the Gypsy/Traveller context, applying the Supreme Court’s guidance in Wolverhampton CC and others v. London Gypsies and Travellers and others [2023] UKSC 47; [2024] 1 AC 983.

The Court accepted that the Council has a Local Plan allocation for a Gypsy/Traveller site and that injunctive relief is necessary to facilitate the Council’s orderly delivery of that allocation, as part of the Wharf Road Project, preventing piecemeal and unlawful development that would frustrate the planned scheme.
