Landlord Licensing in Wales
Part 1, Housing (Wales) Act 2014, established a national landlord licensing scheme for Wales. A landlord who is unlicensed cannot serve notice under s.21, Housing Act 1988 (s.44, 2014 Act), but, in Jarvis v Evans, a Circuit Judge held that such a landlord is additionally prohibited from serving notice under s.8, Housing Act 1988. In effect, an unlicensed landlord cannot recover possession.
Following a change in legal representation, the landlord is now appealing to the Court of Appeal.
