Landmark’s Kimberley Ziya and Samuel Lear of Charles Russell Speechlys LLP have produced a Q&A on cost apportionment for shared facilities under the right to manage which has been published in Estates Gazette.

This follows the recent Supreme Court decision in FirstPort Property Services Ltd v Settlers Court RTM Co Ltd and others a case which concerns leaseholders’ right to exercise the ‘Right to Manage’ their block where it shares facilities with other blocks on the same estate. Kimberley acted for the Appellant, in this case, led by Landmark’s Simon Allison.
