Landmark barristers deal regularly with the full range of environmental appeals, including appeals relating to:

  • environmental permits (including revocation);
  • marine licences;
  • licences to abstract water;
  • licences to impound the flow of inland waters;
  • hazardous substances consents;
  • licences to act as a waste carrier;
  • notices to remediate contaminated land;
  • liability for environmental damage under the Environmental Damage (Prevention and Remediation) Regulations 2009;
  • decisions and penalty notices issued in relation to greenhouse gas emissions trading;
  • decisions and penalty notices issued under the CRC Energy Efficiency Scheme;
  • abatement notices under the Environmental Protection Act 1990;
  • the designation of nitrate vulnerable zones;
  • environmental civil sanctions;
  • non-conformity and enforcement notices issued under the Ecodesign for Energy-Using Products Regulations;
  • the Energy Information Regulations;
  • the Single Use Carrier Bags Charge (Wales) Regulations 2010;
  • the Green Deal Framework (Disclosure, Acknowledgement, Redress etc.) Regulations 2010;
  • the Energy Savings Opportunity Scheme Regulations 2014.

Some of these appeals can give rise to sufficient complexity to warrant, in some cases, a public inquiry. Many of our barristers have substantial experience of the inquiry process given their extensive planning practices, which often require them to deal with technical, specialist evidence on environmental matters. However, even when a public inquiry is not considered necessary, and the appeal is to be determined on the basis of an informal hearing and/or written submissions, our barristers can assist with strategic advice, the drafting of documents, and appearing at a hearing to ensure that any technical case is explained to the decision-maker in the clearest possible terms.

Should you be seeking assistance in relation to an environmental appeal of a type that is not listed above, please contact our practice managers as there is a very high likelihood that at least one of our barristers will have the experience that you require, such is the breadth of expertise in environmental law in chambers.
