The court found that the Ministry of Justice had not considered the impact of changes proposed in the 2018 contractual arrangements so that the geographic areas to be bid for were much larger had not thought through the impact that this would or could have on the not for profit sector. The court also identified that the MOJ did not grapple with the public sector equality duties when making their decision. Fiona Scolding QC appeared for the defendant. Click here for the judgment.
