Court of Appeal to hear challenge to Use Class E and permitted development rights

On Tuesday 5th October 2021, the Court of Appeal will hear an appeal against the Divisional Court’s decision to refuse a challenge by Rights: Community: Action against the introduction of Use Class E and certain permitted development rights. The challenge is based on the requirements for strategic environmental assessment. The new permitted development rights introduce a right to extend upwards by two additional storeys to create new homes and a right to demolish certain buildings for rebuild as new dwelling houses. The new Class E covers commercial, business and service uses. Paul Brown QC and Alex Shattock will be appearing for Rights: Community: Action. Rupert Warren QC and Anjoli Foster will be appearing for the Secretary of State.
