Claimants given permission to appeal in “abortion buffer zone” case

The Claimants in Dulgheriu v Ealing LBC [2018] EWHC 1667 (Admin) have been given permission to appeal to the Court of Appeal.  This case relates to the implementation by Ealing Council of a Public Spaces Protection Order (“buffer zone”) under s.59 of the Crime Policing and Anti-Social Behaviour Act 2014.  The Order prevents people from expressing views relating to abortion in the vicinity of an abortion clinic in Ealing.  It raises important issues relating to the use of these controversial anti-social behaviour measures and articles 8 (right to private and family life),  9 (freedom of religion), 10 (freedom of expression) and 11 (freedom of assembly) of the ECHR.  The appeal will be heard later this year.  Ben Fullbrook  acts as junior counsel for the Appellants.  For press coverage see here.
