Challenge to new rules on permitted development

Rights: Community: Action has today sent a pre-action letter setting out its proposed grounds of challenge to the new rules on permitted development that are due to come into effect on 1 September. These rules have been hailed as one of the most radical developments in planning law for a generation. RCA is arguing that the failure to undertake Strategic Environment Assessment, or proper consultation or equalities impact assessment renders the rules unlawful and will seek a stay on their effect at least until parliament has a chance to debate the rules.
