Yaaser’s practice covers the breadth of property law issues. He regularly advises, and appears in court, on issues related to obtaining possession, business leases, rights of way, profits a prendre, overage agreements, enfranchisement, restrictive covenants, service charges, boundary disputes, forfeiture and unlawful eviction. 

His recent cases include: 

  • Olagbaju v Ifedha (2017): An appeal against the grant of a possession order before HHJ Luba QC. Yaaser successfully argued that a letter from a local authority on the day of the trial which purported to pay housing benefit – thereby clearing the rent arrears – did not prevent the Judge from granting possession. 

  • Sledkova v Sidworth Street Ltd (2016): High Court application by the claimant to set aside a Freezing Order on the grounds of non-disclosure and failure to comply with the CPR rules at the without-notice hearing. 

  • Royal Borough of Greenwich v Jardess (2016): Acting for Greenwich in a Three-day, multi-track trial. Yaaser successfully argued that the tenant had ceased to use the property as his only or principal home and had sublet the property. 

  • Royal Borough of Greenwich v Suhitharan: The landlord sought to forfeit the lease held by defendant tenant who ran a restaurant. The issue was whether the defendant was breaching the user clause by selling a certain amount of takeaway food. 

  • Noel v Knight (2016): A claim involving a boundary dispute between neighbours before the Property Chamber of the First-tier Tribunal. 

  • Rights of way and boundary disputes: Yaaser is regularly instructed to advise, and appear in court, on the question of whether rights of way have been acquired. He has also been instructed on boundary disputes in the courts. 

  • Landlord and tenant: Yaaser is regularly instructed in landlord and tenant issues, including possession claims, disrepair, breaches of covenant, forfeiture, assignment and unlawful eviction. 

  • Business leases: Yaaser has worked on lease renewals, the dissolution and restoration of lessees and compensation under section 30(1)(f) of the Landlord and Tenant Act 1954 and, dilapidations and yielding up obligations. 

  • Leasehold enfranchisement: Yaaser advises leaseholders and freeholders on enfranchisement and related issues.
