Practice Summary

Described by Legal 500 as “an up-and-coming star of the property Bar”, Tom was called in 1995. He joined Landmark Chambers in 2003 from a commercial/chancery Chambers. Tom is an experienced trial advocate, who is frequently instructed in cases requiring effective cross-examination, and he has appeared in leading cases at appellate level. He has appeared in all of the courts and tribunals which determine property disputes (including the High Court, the County Court, the Court of Appeal, the Privy Council (with a leader), the LVT, the Lands Tribunal, and before HM Land Registry Adjudicators) and he is a qualified mediator. Recent cases of note include Baxter v Mannion [2011] 1 WLR 1594 (CA) (adverse possession and registered land), MW Trustees v Telular [2011] L&TR 19 (Ch) (waiver of defective service of break notice), Cusack v Harrow 2011] EWCA Civ 1514 (CA)1] EWHC 460 (QB) (obstruction by highway authority of frontager's right of access to the highway) and Re Zenios [2011] EWCA Civ 1645 (CA) (modification of restrictive covenants under s.84 of the Law of Property Act 1925).Tom endeavours to turn around paperwork quickly and to provide clear, practical and commercially-orientated advice.


Property

Tom is instructed in all types of property litigation (especially litigation arising in a commercial context), including real property disputes, landlord and tenant litigation and cases concerning property-related professional negligence.  He is the author of the leading practitioner work on notices (namely Property Notices (Jordans, 2011 2nd edition) and, as a result, he is frequently instructed in litigation concerning notices and break clauses. QUALIFICATIONS

Tom graduated from New College, Oxford in 1992 with a First Class Honours degree in Politics, Philosophy and Economics. He taught economics for a year at Winchester College before studying law at City University. Tom was awarded scholarships by New College, City University and the Inner Temple. During 1998 he was a Judicial Assistant to the Court of Appeal.

Tom has lectured widely (including to the Chancery Bar Association, the Property Litigation Association and the RICS) and he is the author of the leading practitioner work on property notices.

Tom is a member of the Chancery Bar Association, the Property Bar Association and the Professional Negligence Bar Association. He is also a qualified ADR Group Accredited Mediator.
